Inheritance Tax questions on SQE1 reward method. This free PDF sets out the three kinds of transfer, the exemptions and the order to use them, business and agricultural relief as changed on 6 April 2026, a seven-step method for the death estate, the residence nil-rate band and lifetime gifts on death, with three fully worked examples.

Updated October 2026 · checked against the SQE1 specification, the Inheritance Tax Act 1984 and the Finance Acts on legislation.gov.uk, GOV.UK and the HMRC Inheritance Tax Manual on 21 October 2026. General information, not tax or legal advice.

Where Inheritance Tax sits in SQE1

The SRA examines taxation only inside three subjects. Inheritance Tax is mainly in Wills and the Administration of Estates (FLK2): lifetime transfers that are immediately chargeable or potentially exempt, gifts with a reservation of benefit, transfers on death, exemptions and reliefs, and the scope of the anti-avoidance rules, plus the probate points of valuation, excepted estates, funding the first payment and who bears the tax. Business Law and Practice (FLK1) adds business property relief. The law examined is the law four calendar months before the window opens, so both 2027 sittings use the 2026 to 2027 tax year.

The figures at a glance

Inheritance Tax in 2026 to 2027
RuleFigureWhen it applies
Nil-rate band£325,000Fixed to 2030 to 2031; unused band can pass to a spouse or civil partner
Residence nil-rate band£175,000A home passing to direct descendants; tapers above £2 million
Death rate40%36% if at least 10% of the baseline amount goes to charity
Lifetime chargeable transfers20%Chiefly gifts into most trusts
Potentially exempt transfers7 yearsGifts to individuals: exempt if the donor survives 7 years
Taper relief80% to 20% of the taxGifts made 3 to 7 years before death
Annual exemption£3,000Unused part carried forward one year only
100% business and agricultural relief£2.5 millionFrom 6 April 2026; 50% above it and on AIM shares
Paying the tax on death6 monthsFrom the end of the month of death

The order is the method

Most wrong options use the right rule in the wrong order. On a death, deal with the lifetime gifts first, oldest first: chargeable transfers in the seven years before the death use the nil-rate band before the estate does, while the residence nil-rate band never applies to gifts. For the estate, value it, deduct debts, then reliefs, then exemptions, then the residence nil-rate band and what is left of the nil-rate band, and charge the rest.

Lifetime gifts

A gift to a person is a potentially exempt transfer: no tax unless the donor dies within seven years. A gift into a discretionary trust is taxed now at 20%, grossed up if the donor pays the tax. On death within seven years both are recalculated at 40%, with taper relief for gifts more than three years old, and lifetime tax already paid is deducted but never refunded.

The residence nil-rate band

Up to £175,000 extra where a home passes on death to children, grandchildren or their spouses. It is capped at the value of the home, reduced by £1 for every £2 that the estate exceeds £2 million, and any unused part can pass to a surviving spouse. Nephews and nieces do not qualify.

New law older materials miss

  • Business and agricultural relief: for transfers from 6 April 2026, 100% relief applies only to the first £2.5 million of qualifying property, shared between the two reliefs, with 50% above it. A spouse’s unused allowance can be transferred, up to £5 million.
  • AIM shares: now relieved at 50%, not 100%.
  • Bands frozen: the nil-rate band, the residence nil-rate band and the £2 million taper threshold are fixed until 2030 to 2031.
  • Pensions: unused pension funds come into the estate only for deaths from 6 April 2027, after the cut-off for both 2027 SQE1 sittings.

Frequently asked questions

Will the exam give me the rates and thresholds?

The SRA says that where you must apply the value of an exemption, relief, rate or threshold, it will be provided. You still need to know when each one applies, so the guide puts every figure on one page to learn anyway.

Which tax year applies to my sitting?

The law examined is the law four calendar months before the window opens: 11 September 2026 for January 2027 and 12 March 2027 for July 2027. Both dates fall in the 2026 to 2027 tax year.

Does the guide cover income tax and CGT during the administration?

No. The guide covers Inheritance Tax only. The personal representatives’ income tax and capital gains tax are outside it.

Is the guide free?

Yes. Enter your details on this page and we email you the PDF straight away.
